Chandler olice say a man crawled underneath a bathroom stall and exposed himself to a teen girl at a valley grocery store.
Daiveon Dean Ellsberry, 24 was arrested on Monday after an investigation.
On Sunday, police were called to a Safeway near 40th Street and Chandler Boulevard for reports of a possible sexual assault. A 16-year-old employee told police while she was using the restroom at the store where she works, she heard Ellsberry come into the women’s bathroom, sounding “very loud and angry.” She reported that he went into the stall next to the victim and allegedly slid underneath to get inside her stall. Court reports state that Ellsberry also had his pants down.
As Ellsberry attempted to grab the girl, she screamed for her coworkers and shoved him. Ellsberry told the victim to be quiet and at some point let her go. The girl fled to seek help fro her coworkers and Ellsberry ran from the store.
After an investigation and review of video surveillance, on Monday, police identified Ellsberry as the suspect and he was taken into custody at an extended stay living center about a mile and a half from the Safeway.
In an interview with police, Ellsberry admitted that he followed the victim into the women’s restroom and entered into the victim’s stall with his pants down. Ellsberry claims he went into the teen girl’s bathroom stall because he “wanted to ask her if she wanted something” but said the victim was “shutting him down,” so he didn’t say anything. According to court documents Ellsberry claims he didn’t keep trying because the girl said stop. When police told Ellsberry the victim was a minor and only 16 years old, he stated he didn’t feel any different after hearing her age.
Ellsberry has been booked on one count of attempted sexual assault and one count of kidnapping.
