Third Suspect Arrested as Gilbert Sexual Assault Case Deepens

Police say the investigation, which began with allegations of prolonged abuse, has now led to three arrests and multiple felony charges.

Authorities in Gilbert Police Department have made a third arrest in an ongoing sexual assault investigation that has drawn increasing public attention across the East Valley.

On Wednesday, detectives took 43-year-old Jose Guzman into custody on four counts of sexual assault. According to police, the arrest was made on probable cause following continued investigative work. The development came just a day after the department publicly sought help identifying a person of interest connected to the case.

The investigation dates back to December 2025, when officers received a report alleging sustained sexual abuse and violence over an extended period. As the inquiry unfolded, detectives uncovered evidence suggesting the victim’s husband, 38-year-old Austin Nelson, allegedly drugged his wife and arranged for others to assault her while she was unconscious. Investigators further allege that some of the incidents were recorded.

Nelson was arrested in January by the Maricopa County Sheriff’s Office and booked on multiple felony charges, including administering intoxicating substances, voyeurism, unlawful disclosure of intimate images, and facilitating sexual assault.

Around the same time, 41-year-old Evan Torres was also taken into custody. Police allege he engaged in sexual acts with the victim while she was incapacitated and unable to consent. He faces a sexual assault charge.

With Guzman’s arrest, the number of individuals accused in the case now stands at three. Authorities have not indicated whether additional arrests are anticipated but say the investigation remains active.

Gilbert police previously asked for assistance from the public as they worked to identify individuals potentially connected to the alleged crimes. Updates on the case can be found through official releases from the town and law enforcement agencies.

The case continues to move through the criminal justice system as prosecutors review the charges.
