Man Sentenced for Tampering with Food Items in Retail Stores

An Arizona man who was arrested and tried for tampering with food in retail stores in Phoenix will avoid jail time.

Attorney General Mark Brnovich announced David Lohr was sentenced on October 27, 2022 to seven years of supervised probation on one count of Criminal Damage, a class 2 felony, and three years’ probation on two counts of Adding Poison or Other Harmful Substance to Food, Drink, or Medicine, class 6 designated felonies, for his involvement in tampering with food items at multiple retail stores within the Phoenix metropolitan area in October 2018.

No individuals reported any illness associated with the consumption of the tampered items. Lohr was ordered to pay restitution to a retail grocery chain in the amount of $390.42. The defendant shall participate in a mental health evaluation and any additional recommended treatment.


Lohr was first arrested in October of 2018, and the Maricopa County Attorney’s Office charged him with criminal damage. After Lohr was released from custody, he went to California.

In February 2019, the FBI arrested him for similarly tampering with consumer products in California. He was later sentenced in October 2021 to a 51-month federal prison term followed by three years of supervised release with mental health services.
