Man Arrested For Sexual Assault Of A Female Patient At Phoenix Health Care Facility

A female patient residing in a Phoenix care facility has been the victim of a sexual assault.

Emiliano Fausto, 77-year was arrested on Saturday after allegedly sexually assaulting a female patient who was strapped into her bed at Allegiant Healthcare of Phoenix, near 18th and Van Buren streets.

The victim, who lives at the care facility due repetitive seizures and reduced brain activity, was strapped in her bed to sleep, when Fausto reportedly entered the patient’s room and pulled his pants down. Reports state that Fausto got on top of the female victim and removed her pants, touching her inappropriately.


Around 5 p.m., a nurse entered the room and found Emiliano Fausto on top of her with his pants down.

The victim reported to investigators she told Fausto to get off several times before a nurse walked in to check on her. The nurse yelled at Fausto, who immediately got off the woman. The nurse observed his pants were down and that the patient had been exposed and violated.

The patient told police Fausto had raped her and touched her inappropriately while she was strapped to her bed. A sexual assault exam was conducted on the woman.

During an interrogation, Fausto denied touching the woman, and said he was not capable of doing this thing.

Authorities have confirmed that Fausto was a documented visitor at the facility and was neither a resident nor employed by the facility.

Fausto was arrested and booked into Maricopa County Jail on suspicion of one count of sexual abuse and one count of sexual assault.

His preliminary court hearing has been scheduled for May 2nd.
