Attorney General Mayes Sues to Block Termination of Federal EV Infrastructure Funds

Arizona could lose $48 million in electric vehicle funding due to Trump executive order

PHOENIX – Arizona Attorney General Kris Mayes has joined a multistate lawsuit aimed at halting the Trump administration’s move to terminate billions in federally approved electric vehicle infrastructure funding. Without court intervention, Arizona is expected to lose approximately $48 million designated for expanding EV charging stations statewide.

“Arizona will lose nearly $50 million in critical funding unless the courts block yet another illegal action by the Trump administration,” Mayes said in a statement. “I will not stop fighting to protect Arizona from the flood of illegal and unconstitutional actions by President Trump.”

The dispute centers around the 2022 Infrastructure Investment and Jobs Act (IIJA), also known as the Bipartisan Infrastructure Law. That legislation included $5 billion for the National Electric Vehicle Infrastructure (NEVI) Formula Program to support a national EV charging network.


However, in January 2025, President Trump issued an executive order pausing disbursement of funds related to both the IIJA and the Inflation Reduction Act, which includes NEVI funding. In February, the Federal Highway Administration (FHWA) informed states that it was revoking all previously approved NEVI implementation plans, effectively freezing access to the funds.

The lawsuit, filed by Mayes and attorneys general from 16 other states, seeks to overturn the FHWA decision and reinstate the funding.

States joining Arizona in the lawsuit include California, Colorado, Delaware, the District of Columbia, Hawai’i, Illinois, Maryland, Minnesota, New Jersey, New Mexico, New York, Oregon, Rhode Island, Washington, Wisconsin, and Vermont.

The suit requests a preliminary injunction to immediately restore funding and halt further federal interference with the NEVI program.
